These Terms of Service (“Terms”) govern your access to and use of any website, domain, subdomain, landing page, funnel, form, or service operated by Enad Group LLC or any of its brands, including ECOM37, SCALE37, and Tim Enad Consulting (collectively, the “Company,” “we,” “us,” and the “Site” and “Services”). Depending on the brand and engagement, these may include: paid advertising (such as Meta Ads across Facebook and Instagram, Google Ads, and TikTok Ads), email and SMS marketing, funnels and landing pages, conversion rate optimization, strategy and consulting, ad copy, creatives, tracking setup, and related services.
Some Services may be free (such as strategy or discovery calls), and others may be paid. Paid Services are governed by invoices, proposals, or separate written agreements where applicable. In the event of a conflict between these Terms and a signed agreement for a specific engagement, the signed agreement controls for that engagement.
Advertising, marketing, and consulting results vary based on many factors outside our control. The Company makes no guarantees regarding leads, sales, revenue, ROAS, profitability, ad approvals, account stability, deliverability, or performance of any kind.
Initiating a chargeback or payment dispute after work has begun constitutes a material breach of these Terms. The Company may suspend Services immediately and pursue recovery of amounts owed, including reasonable collection costs where permitted.
The Company reserves the right to refuse, suspend, or terminate Services at any time for any lawful reason, including non-payment, policy violations, risk concerns, or misalignment.
Do not submit confidential, proprietary, or unsolicited ideas. Any information submitted is deemed non-confidential and may be used without obligation.
You agree not to use reviews, complaints, or public statements as leverage to demand refunds or concessions.
All Site content, branding, frameworks, processes, and materials are owned by Enad Group LLC unless otherwise stated. Unauthorized use is prohibited.
